- AcceptanceThese Terms and Conditions (“Terms”) apply to all studio hire and services provided by Halfway Studios (“Halfway”, “we”, “our”) to the person or entity making the booking (“Client”, “you”, “your”). These Terms, together with the Booking Confirmation, form the entire agreement between us.By confirming a booking, you acknowledge that you have read, understood, and accepted these Terms.
- BookingsAll studio bookings are subject to availability and are confirmed once you receive a written Booking Confirmation from Halfway (via email or our booking platform). The Booking Confirmation will specify the studio space, date, time, duration, services included, and the total fee.Where a booking is made on behalf of a business or group, the person making the booking is personally responsible for compliance with these Terms and payment of all fees, unless otherwise agreed in writing.
- Studio RulesWhile using the studio, you and anyone attending your session (“Your Group”) must:
– Treat the studio, equipment, and shared spaces with care and respect.
– Not consume food inside the recording spaces. Water is permitted. Other drinks may be consumed in designated areas only.
– Not consume alcohol on the premises unless expressly agreed with Halfway in advance.
– Not engage in any hazardous activities, including the use of open flames, smoke machines, or any materials that may damage the space or equipment.
– Not alter, move, or modify any studio infrastructure, furniture, or equipment without our express permission.
– Follow all reasonable directions given by Halfway staff regarding safety, conduct, and use of the space.
– Keep noise to appropriate levels, particularly when entering and exiting the building, in consideration of neighbouring businesses.Only people listed in or reasonably contemplated by your booking may enter the studio during your session. We reserve the right to refuse entry to additional guests at our discretion.
Setup and packdown must be completed within your booked session time. If additional time is required and available, it will be charged at our standard hourly rate.
You are responsible for leaving the studio in the same condition it was in at the start of your session. Any breach of these rules by Your Group will be treated as your responsibility.
- Third-Party Contractors and Additional CrewIf you bring any third-party suppliers, contractors, or additional crew to your session (including but not limited to hair and makeup artists, videographers, photographers, stylists, or talent), they are considered part of Your Group for the purposes of these Terms.You are fully responsible for the conduct of any third-party contractors and crew you engage, including any damage to the studio, equipment, or premises caused by them or their equipment. This includes any equipment, tools, or materials they bring onto the premises.
You must ensure that all third-party contractors and crew comply with these Terms, including the Studio Rules set out in clause 3. Halfway reserves the right to refuse entry to any third-party contractor or crew member at its discretion.
Halfway accepts no liability for any loss, damage, or injury suffered by third-party contractors or their equipment while on the premises, except where directly caused by Halfway’s negligence.
- EquipmentHalfway provides studio equipment as part of the booking (cameras, microphones, lighting, audio interfaces, and other items as specified). Equipment must only be used for its intended purpose and in accordance with any instructions provided by our team.For sessions without a Halfway operator present, you must have received a briefing or induction on the equipment before your session. We are not liable for content quality issues arising from self-operated sessions, nor for any content loss resulting from user error, including but not limited to failure to commence or verify recording, incorrect equipment settings, or mishandling of storage media.
You are responsible for any damage to our equipment that occurs during your session, except where caused by Halfway’s own negligence. We will assess any damage fairly, and you agree to pay repair or replacement costs within 14 days of receiving an invoice.
Equipment must not be removed from the studio or premises without the express written permission of Halfway. Any unauthorised removal of equipment will be treated as theft and reported to the relevant authorities.
In the event of damage to, loss of, or theft of Halfway’s equipment caused by you or Your Group, you may be liable for all reasonable costs arising from the loss of use of that equipment, in addition to repair or replacement costs. This includes but is not limited to the cost of hiring substitute equipment and any revenue lost by Halfway as a direct result of the equipment being unavailable.
Bringing your own equipment:
You may bring your own equipment into the studio with prior notice. Any equipment connected to our power supply must be in safe working order. We accept no liability for damage to your own equipment while on our premises, except where caused by our negligence.
- Content OwnershipYou own all content created during your session. Halfway does not claim any ownership over your recordings, footage, or other creative output.You are solely responsible for ensuring your content does not:
– Breach any law or regulation.
– Infringe on any third party’s intellectual property rights.
– Contain material that is defamatory, obscene, or promotes violence or discrimination.
Halfway is not responsible for any content you create or distribute. Any pre-existing material you bring to the session remains your responsibility, including ensuring you have the necessary rights and licences to use it.
- Social Media and MarketingWe love showcasing the work that happens at Halfway. Unless you opt out, you agree that Halfway may:
– Capture behind-the-scenes photos during your session for use on our social media channels.
– Tag or mention you or your project when sharing content related to your session.We will not use, repurpose, or redistribute your actual recorded content (audio, video, or other creative output) without your separate, express written consent.
If you would prefer to opt out of behind-the-scenes content, please let us know in writing before your session.
We appreciate (but do not require) a tag or mention of @halfwaystudios when you share content recorded at our space.
- Content Delivery and StorageContent will be delivered to you via a shared drive link, USB, or SSD, as agreed at the time of booking. If you have an alternative delivery preference, please let us know in advance.Halfway may temporarily store your content for your convenience, but we do not guarantee the security or longevity of stored files. You are responsible for maintaining your own backups.
Any content not collected or downloaded within 60 days of your session will be deleted without further notice. If you need an extension, please contact us before the 60-day period expires.
- Fees and PaymentThe fee for your session will be set out in your Booking Confirmation and is due and payable in accordance with the invoice provided by Halfway.All fees are quoted in Australian dollars and are exclusive of GST unless stated otherwise. GST will be added where applicable.
Additional charges may apply for:
– Time used beyond the booked session (charged at our standard hourly rate).
– Equipment damage or replacement.
– Additional services or deliverables not included in the original booking.
We reserve the right to withhold delivery of content until all outstanding fees have been paid in full.
A flat late payment fee of $25.00 applies to invoices not paid within the specified payment terms, in addition to any further collection costs reasonably incurred.
- Cancellations and ReschedulingWe understand plans change. Our cancellation policy is as follows:
– More than 24 hours’ notice: Full refund or free reschedule.
– Less than 24 hours’ notice or no-show: A cancellation fee of 50% of the booking fee applies.Halfway reserves the right to cancel or reschedule a booking at any time, in which case you will receive a full refund of any fees paid. We will provide as much notice as reasonably possible.
Package Deal Cancellations:
Where the Client has purchased a package of multiple sessions at a discounted package rate, the following applies in the event of early cancellation of the remaining sessions in the package:
– Any sessions already completed will be recalculated at Halfway’s standard (non-discounted) session rate at the time the package was purchased.
– The refund amount will be the total package fee paid, less the recalculated cost of completed sessions at the standard rate.
– If the recalculated cost of completed sessions at the standard rate exceeds the total package fee paid, no refund will be issued and no additional amount will be payable by the Client.
– For the avoidance of doubt, the package discount is applied on the basis of the Client completing all sessions in the package. Early cancellation of the package constitutes withdrawal from that commitment, and the discount is adjusted accordingly.
- Damage and LiabilityYou are responsible for any damage to the studio, equipment, or premises caused by you or Your Group during your session, except to the extent caused by Halfway’s own negligence.To the maximum extent permitted by law, Halfway’s total liability to you for any loss or damage arising from these Terms is limited to 100% of the fee paid for the relevant booking.
Neither party is liable to the other for any indirect, consequential, or special loss, including loss of revenue, profit, business opportunity, or reputation.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law. Consumer guarantees under the Australian Consumer Law may apply.
- Damage Bond (if applicable)For certain bookings, Halfway may require a refundable damage bond to be paid prior to the session. The amount will be specified in your Booking Confirmation.The bond will be refunded in full within 7 business days of your session, provided no damage has occurred and the studio has been left in an acceptable condition. If damage has occurred, reasonable repair or replacement costs will be deducted from the bond, and any additional costs will be invoiced separately.
- Access and ParkingThe studio is located at 62 Bay View Terrace, Claremont WA 6010. Access details and any entry instructions will be provided in your Booking Confirmation or by separate communication prior to your session.Limited parking may be available in the surrounding area. Halfway does not guarantee parking availability and accepts no responsibility for any parking infringements incurred by you or Your Group.
You must not obstruct shared access areas, stairwells, or neighbouring premises when loading or unloading equipment.
- Intellectual PropertyAll intellectual property created before your session remains the property of the party who created it. You must not use Halfway’s branding, logos, or other intellectual property without our written permission.All intellectual property created during your session belongs to you. Where Halfway captures behind-the-scenes content in accordance with clause 7, you grant us a non-exclusive, revocable licence to use that content for marketing purposes.
You warrant that your use of the studio and any materials you bring do not infringe any third party’s intellectual property rights.
- Force MajeureNeither party is liable for failure to perform obligations under these Terms where performance is prevented by circumstances beyond reasonable control, including natural disasters, government restrictions, power failures, or pandemic-related closures.If a force majeure event continues for more than 14 days, either party may terminate the booking by written notice, and any fees paid will be refunded in full.
- PrivacyAny personal information you provide will be collected, used, and stored by Halfway in accordance with the Privacy Act 1988 (Cth) and only for the purposes of providing studio services, processing payments, and marketing communications (which you may opt out of at any time).We will not share your personal information with third parties except where required by law or necessary for payment processing.
- ConfidentialityBoth parties agree to keep confidential any commercially sensitive information shared in connection with a booking. This obligation survives the end of any booking.
- Governing LawThese Terms are governed by the laws of Western Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Western Australia.
- GeneralIf any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force.These Terms may be updated from time to time. The version in effect at the time of your booking applies to that booking.
All notices under these Terms must be in writing and sent to the contact details provided in the Booking Confirmation.
